Terms of Site Use and License to Use State Photographs

This Internet site (hereinafter "the Site") is administered and maintained by the Prime Minister's Office (hereinafter "the Ministry"). All content on this Site, including – inter alia – text, photographs, images, drawings, maps, audio clips, video clips, graphics and software applications, are protected by copyright, which belongs to the Ministry or to third parties. All rights to these works are retained by the copyright holders. These works may not be copied or used in any way except in accordance with the terms of the license below or according to law (for example, works the copyright of which has expired according to law).

License to Use Photographs

Summary of License, for the convenience of the User and Subject to the Full Terms of Use:

You may:

Use any photograph that appears on the Site, except photographs which bear the notice "© Copyright held by the photographer" Copy, distribute, display and send any such photograph, but not all of them together.

You must:

Indicate – next to the photograph – the name of the photographer and the Government Press Office

You are prohibited from:

Altering the photograph or using it in any way that harms the name or the reputation of the State, the Government Press Office or the photographer. Using the photograph for commercial advertising or political activity. Creating derivative works, or using the photograph in any other manner (apart from what you are permitted, as per the foregoing). Using the photograph in any manner that violates the law.

A. General

1. The Ministry hereby offers the public a license to use the photographs on the Site, the copyright of which belongs to the State of Israel, in accordance with the following. It will be emphasized that the State of Israel does not hold the copyright to all photographs that appear on the Site, and this license is – therefore – granted only in regard to those photographs for which the State of Israel holds the copyright.

2. The aforesaid photographs are offered for use subject to the terms of this license (hereinafter "the License"). The License is given in regard to individual copies of the photographs only. The License is not given in regard to other protected material on the Site or in regard to the entire Site, including as a collection, and it is hereby clarified that copying the collection of photographs in its entirety – is prohibited.

3. By realizing any of the rights granted according to this License, the User (as defined below) accepts, and consents to, the terms of the License. The Licensor (as defined below) grants the User the rights described herein subject to the User's consent to these terms.

B. Definitions

1. "The Licensor" is the Prime Minister's Office of the State of Israel.

2. "The Original Author" is the person or entity that created the work.

3. "The Photograph" is the copyright-protected photograph being offered according to the terms of this License.

4. "The User" is the person or entity realizing the rights according to the conditions of this License and that has not previously violated the conditions of this License.

C. Granting a License

Subject to the terms of this License, the Licensor hereby grants the User a global, non-exclusive license, without royalties, which is unlimited vis-à-vis time and which is for any purpose – apart from use in the framework of commercial advertising of any kind, including the promotion of goods, services or anything whatsoever, and apart from use in the framework of political activity – to use the photographs to which it holds the copyright, in the following ways and subject to the following conditions:

1. Copying the Photograph, distributing the copies thereof, displaying it publicly, broadcasting it, performing it in public and granting a subsidiary license to use the photograph, provided the user does not distort, damage, alter or use it in any other fashion, including in any context, which diminishes the value of the work or which may – in the opinion of the Original Author or of the Licensor – cast aspersion on the Original Author or of the Licensor..This article will be deemed to have been violated if the Original Author or the Licensor give notice that, in his opinion, the User committed one or more of the aforesaid acts.

2. In any use of the Photograph, the User must indicate the name of the photographer and the Government Press Office.

3. The rights detailed in paragraph #1 above may be realized in any media or format. The aforesaid rights include the right to make such technical changes as are necessary in order to realize the rights in other media or formats but apart from this, the User is not given the right to make changes in the Photograph or create derivative works or carry out any action regarding the Photograph that are not enumerated in this paragraph, unless the Licensor gave him advance written consent. In this regard, one may contact the Ministry at the address that appears below.

4. For the avoidance of doubt, the right to use the aforesaid Photographs does not include photographs the copyright of which belongs to third parties other than the State of Israel. On the Site there are photographs which bear the explicit notice "© Copyright held by the photographer,". The use of these photographs requires the prior permission of their copyright holders.

5. It will be pointed out that the License does not necessarily include the moral right to the Photograph, and it is possible that this belongs to the Original Author. In the event of concern for the infringement of the Original Author's moral right, the User must apply to the Original Author of the Photograph and settle this issue with him.

6. Making use of the Photograph in a manner that deviates from this License is subject to advance permission from the Licensor or the copyright holders, as the case may be.

7. Making use of the Photograph in a manner that deviates from this License is subject to advance permission from the Licensor or the copyright holders, as the case may be.

D. Expiry of the License

This License and the rights granted herein shall expire and terminate immediately upon the User's violation of the conditions of the License.

E. Warranties, Liability and Limitation of

The License in paragraph C above is offered to the public "As Is". Use of the License is at the responsibility of the User alone.

The State of Israel reserves the right to change the Terms of use on the Site, the contents of the Site and the terms of the License at any time.

The State of Israel reserves the right to remove material from the Site at any time.

The State of Israel shall not be liable for the suitability of this License to the the User's needs.

The State of Israel shall not be liable for changes made to the material presented under this License by the User or by any third party.

The State of Israel shall not be liable towards any third party, arising from the use of the License or Site.

The State of Israel shall not be liable for any damage caused to the User or to any third party as a direct or indirect result of use of the Site including downloading of photographs according to the terms of the License, damage caused as result of use of the software applications that were downloaded directly via the service or were activated as a result of use of the Site and internet applications (such as Java, Active-X and JavaScript).

F. Links

This Site contains links to other sites. The provisions below apply to the use of these links without limiting the remaining provisions in these "Terms of Use". The links are solely designed for the convenience of the User. Note that in general, the State of Israel is not directly, indirectly or contributorily responsible for, links, presented on the Site, to external sites not maintained by the State of Israel (hereinafter – "Third-Party Sites"). It will be clarified that the State has no information regarding the various materials on the Third-Party Sites directed to by the links, or regarding updates thereon and it does not supervise these sites, including their content. The State of Israel and the owners of the Third-Party Sites have no legal or commercial relations affecting the content of Third-Party Sites. Links to Third-Party Sites shall not be construed as an endorsement, recommendation or favoring by the State of Israel or by the Ministry of said Third Party Sites, including documents and other materials to be found therein, of the operators of said sites or of products offered on said sites.

G. Miscellaneous

1. Additional terms regarding the aforesaid License agreement:

a) A party to this License will not be considered as having waived any term of this License or as having agreed to the violation of any of its terms unless the waiver or agreement was made in writing and signed by said party. This will be done with advance coordination with the Legal Advisor of the Ministry.

b) This License constitutes the full agreement between the parties regarding the work in question. There are no understandings, agreements or warranties that have not been detailed herein. The Licensor will not be subject to additional terms which may appear in any message from the User. This License may not be altered without the joint consent in writing of the Licensor and the User.

2. Confidentiality – Personal information submitted to the Ministry via this Site will remain confidential in accordance with the provisions of the Protection of Privacy Act, 1981.

3. Official Publications of the State of Israel – In the event of any contradiction or discrepancy between material published on the Site and material appearing in official, written publications of the State of Israel, only the material in the aforesaid official publications shall be deemed correct.

I. Translation/Versions

To the extent that any contradiction or inaccuracy is discovered between the Hebrew version of the "Terms of Site Use and License to Use State Photographs" and that of any other language, the Hebrew version shall prevail.
